H1: Verwerkingsrollen en verwerkersafspraken

1. Rollen

Wanneer u een document uploadt naar ShareSafe.ai, bent u verwerkingsverantwoordelijke in de zin van artikel 4 lid 7 AVG voor de persoonsgegevens in dat document. El Niño B.V., handelend onder de naam VaultLM (KVK 08140115, Kuipersdijk 6c, 7512 CH Enschede), treedt voor de duur van de verwerking op als verwerker in de zin van artikel 4 lid 8 AVG.

2. Verwerkersafspraken voor de gratis dienst

Omdat de gratis dienst geen account vereist, is er geen overeenkomst om een ondertekende verwerkersovereenkomst aan te hechten. De onderstaande afspraken vormen daarom onze openbare verwerkerstoezegging. Zij gelden voor iedere verwerking via de gratis dienst en wij houden ons eraan gebonden.

2.1 Onderwerp en duur. De verwerking betreft het door u aangeboden document en duurt uitsluitend de verwerkingsrun: van ontvangst tot levering van het veilige bestand, het verwerkingsbewijs en, in pseudonimiseringsmodus, de Identity Key.

2.2 Aard en doel. De verwerking bestaat uit geautomatiseerde detectie van gevoelige gegevens en het genereren van een geanonimiseerde of gepseudonimiseerde versie. Er vindt geen verwerking voor enig ander doel plaats. Wij gebruiken documentinhoud niet voor het trainen van modellen.

2.3 Categorieën gegevens en betrokkenen. De aard van de dienst brengt mee dat de categorieën worden bepaald door de inhoud van uw document. U staat ervoor in dat u bevoegd bent het document te laten verwerken.

2.4 Vertrouwelijkheid. De verwerking is volledig geautomatiseerd. Geen natuurlijke persoon neemt kennis van de documentinhoud. Onze medewerkers hebben geen toegang tot documenten in verwerking.

2.5 Beveiliging. Wij treffen passende technische en organisatorische maatregelen als bedoeld in artikel 32 AVG. De actuele maatregelen en de exacte verwerkingsroute staan beschreven op de securitypagina.

2.6 Subverwerkers. Wij schakelen uitsluitend de subverwerkers in die zijn vermeld op sharesafe.ai/subprocessors. Wijzigingen kondigen wij op die pagina aan onder vermelding van datum. Door gebruik van de dienst verleent u algemene toestemming voor de daar vermelde subverwerkers.

2.7 Doorgiften. Documentinhoud wordt uitsluitend binnen de Europese Unie verwerkt en opgeslagen. Voor zover een subverwerker buiten de EER is gevestigd, betreft dit ondersteunende diensten — beveiliging en levering van het verkeer, transactionele e-mail en foutregistratie — en is de doorgifte gebaseerd op de standaardcontractbepalingen van de Europese Commissie. De subverwerkerspagina vermeldt per partij de locatie en grondslag.

2.8 Verwijdering. Na afronding van de run verwijderen wij het origineel, het veilige bestand, de bestandsnaam en de Identity Key uit het werkgeheugen. Wij bewaren geen kopie. Er valt na de run niets te verwijderen op verzoek, omdat er niets wordt bewaard.

2.9 Verantwoording. Bij iedere run hoort een verwerkingsbewijs met tijdstip, verwerkingsregio, gekozen modus, gedetecteerde categorieën (als aantallen) en onze bewaarverklaring. Dit bewijs stelt u in staat de verwerking aan te tonen.

2.10 Medewerking. Voor vragen van betrokkenen of toezichthouders die onze verwerking betreffen, verlenen wij redelijke medewerking. Contact: hi@sharesafe.ai.

3. Voor teams en organisaties

Organisaties die structureel met VaultLM willen werken, sluiten met ons een ondertekende verwerkersovereenkomst met subverwerkersnotificatie, bewaarinstellingen en een security-reviewtraject. Aanvragen via hi@sharesafe.ai. U spreekt met een oprichter, niet met een wachtrij.

H1: Processing roles and processor commitments

1. Roles

When you upload a document to ShareSafe.ai, you are the controller within the meaning of Article 4(7) GDPR for the personal data contained in that document. El Niño B.V., trading as VaultLM (Dutch Chamber of Commerce no. 08140115, Kuipersdijk 6c, 7512 CH Enschede, the Netherlands), acts as processor within the meaning of Article 4(8) GDPR for the duration of the processing.

2. Processor commitments for the free service

Because the free service requires no account, there is no contract to attach a signed data processing agreement to. The commitments below therefore constitute our public processor commitment. They apply to every processing operation performed through the free service and we consider ourselves bound by them.

2.1 Subject matter and duration. The processing concerns the document you submit and lasts only for the processing run: from receipt until delivery of the safe file, the processing receipt and, in pseudonymise mode, the Identity Key.

2.2 Nature and purpose. The processing consists of automated detection of sensitive data and generation of an anonymised or pseudonymised version. No processing takes place for any other purpose. We do not use document content to train models.

2.3 Categories of data and data subjects. By the nature of the service, the categories are determined by the content of your document. You warrant that you are authorised to have the document processed.

2.4 Confidentiality. Processing is fully automated. No natural person accesses the document content. Our staff have no access to documents in processing.

2.5 Security. We implement appropriate technical and organisational measures within the meaning of Article 32 GDPR. The current measures and the exact processing route are described on the security page.

2.6 Sub-processors. We engage only the sub-processors listed at sharesafe.ai/subprocessors. Changes are announced on that page with the date of change. By using the service you grant general authorisation for the sub-processors listed there.

2.7 Transfers. Document content is processed and stored exclusively within the European Union. Where a sub-processor is established outside the EEA, this concerns supporting services — traffic security and delivery, transactional email and error monitoring — and the transfer is based on the European Commission's Standard Contractual Clauses. The sub-processor page states location and transfer basis per party.

2.8 Deletion. Upon completion of the run we discard the original, the safe file, the filename and the Identity Key from working memory. We retain no copy. There is nothing to delete on request after the run, because nothing is retained.

2.9 Accountability. Every run produces a processing receipt stating the timestamp, processing region, selected mode, detected categories (as counts) and our retention statement. The receipt enables you to demonstrate the processing.

2.10 Assistance. We provide reasonable assistance with data subject requests and supervisory authority enquiries concerning our processing. Contact: hi@sharesafe.ai.

3. For teams and organisations

Organisations working with VaultLM on a structural basis enter into a signed data processing agreement with us, including sub-processor change notification, retention controls and a security review path. Requests via hi@sharesafe.ai. You will talk to a founder, not a queue.
